Chapter 8 - Information Governance and Legal Functions: According to the authors, Smallwood, Kahn, and Murphy, IG is perhaps one of the functional areas that impact legal functions most. Failure to me
Organizations have to manage the e-discovery for various reasons. First is that there are instances of events that occur that do not auger well with the organization. An example of the occurrence is data breach such as data theft (Smallwood, 2019). In the case of data theft, the e-discoveries come in handy as they will be a source of evidence that indeed the theft occurred. It means that the organization has to keep the records of events that take place, bearing in mind that there can be instances of data theft like the one mentioned; thus there needs to be proof that will act as evidence in case of a legal suit.
Secondly, the organization needs the e-discovery process to ensure that the organization has kept a log of all the necessary files in the system. Additionally, they shall have a log of all the alterations that occur in the organization’s network (Smallwood, 2019). Keeping log of the files will make it easy for the personnel to locate these files within the shortest time possible. A log of the changes in the network will be essential as it will enable the organization to keep track of the activities that take place in the system. AS such, there shall be relevant actions to be taken against any suspicious activity in the network.
Finally, e-discovery makes it possible for the organization to address cases of cyber-attacks and proceed with legal actions based on the crimes committed. The files will be evidence of the illegalities that took place in the system (Smallwood, 2019). The files and logs will be evidence enough to conduct legal proceedings of the persons concerned with the crimes. Ideally, e-discoveries are meant to protect the organization from the imminent cyber threats that are bound to take place.
