Case Brief The Darling Case

Introduction:

By strengthening inter-professional communication for physicians and health professionals, patient outcomes can improve and patient-centered care is encouraged. The Darling case (Chapter 8) illustrates how inter-professional communication issues are associated with a wide variety of medico-legal problems, including delays in diagnosis, mishaps in surgery, medication adverse events, and failures in monitoring or follow up of patients.

Read these two brief articles, Chapter 1, and Chapter 8 of the text to prepare.  (2011). Strengthening inter-professional communication, CMPA Empowering better healthcare.  Thompson, S. (2017). What is the corporate negligence doctrine?, Small Business Chronicle.

Instructions:

For this assignment, I am tasking you with developing a presentation to co-present with the medical director of your institution. It will be used to train current and new physicians on the importance of inter-professional collaboration and methods for addressing ethical issues in the medical organizations. You will use the Darling case to illustrate the key points of your presentation. The audience is physicians. Use the Code of Ethics for physicians, nurses, and organizations found in your book as a guide.

Your presentation must include:

1. Briefly describe the legal issues in this case.

2. Briefly outline the four elements of negligence (found in Chapter 1) as it applies to this case. Include how the hospital failed in its ethical duty to the patient.

3. Define inter-professional communication. Deduce from the outcome of this case the issues of inter-professional communication.

4. Describe how corporate negligence would have been avoided with inter-professional communication.
