Description Outline for Research Paper “DOJ Use of Force Review”

Purpose:

This review will evaluate how the FBI, DEA and ATF investigates, reports and Special Agents involving in shooting incidents. We will determine whether these elements adhered to the Agency’s use of force review policies and procedures. We will also determine if the elements obeyed their own use of force shooting incident polices and procedures.

Objectives:

  • To determine the compliance with the agency policy and procedures.

  • Look for value-added recommendations and proposals to improve the proficiency and contribution of the function under review to the possession and agency as a whole

  • To determine the effectiveness of the policy and procedures.

Scope & Methodology:

We will review shooting incidents involving agents that occurred during FY 2015 through 2019. We will use one criterion in concluding which components to include in the review:

  • Components that usually engages in enforcement activities such as an arrest and the execution of search warrants

Methodology:

We will collect data on fire discharges reported by the component.

We will do a background research on the shooting incident review process that includes:

  • GAO, Use of Force, FBI Policy, Training and Review Process

  • Newspaper articles reporting shooting incidents involving law enforcement

  • Law Enforcement Executive Forum

  • International Association of Chiefs Police

For each element of the DOJ, we will review the use of force such as shooting incidents and other files with cases that may have involved a weapon discharge during a particular operation of enforcement.
