Introduction

We are going to build a table, that compares U.S. based and Iraq based company’s ethics, based on classical ethical theory. We are going to look at their stance on privacy, protection of intellectual property, and the protection of Personally Identifiable Information (PII).

Classical Ethical Theory

The U.S based company will use the deontology theory. Chonko L (2018) defines deontology theory as a theory where “people should adhere to their obligations and duties when engaging in decision making when ethics are in play”. The employees will need to abide by the policies and regulations in place.

Deontology theory. The employees of the company will need to do their obligations and duties as per the company and the same for the company as per the country.

Privacy

The U.S. company will guarantee privacy. This is because the company will have well documented privacy policy that also adheres to privacy laws of the federal or state laws. The laws may include the Online Privacy Protection Act, COPPA for collection information about children under 13 as the targeted audience, HIPAA etc.

The Iraq based company cannot guarantee privacy. According to Jawad H (2017) “Iraq has got a privacy protection which is under the Civil Code, but it remains largely undeveloped”. Jawad H (2017) adds further that “there is reference to a right to personal privacy in the Iraqi Constitution of 2005, but guidance with respect to this right is unavailable, and it remains undefined in legislation”. If the country does not have well-formed laws on privacy, then the company cannot come up with well-formed policy on privacy.

Protection of IP

The U.S. based company will guarantee the protection of the Intellectual Property (IP). The company will have an IP policy which will also adhere to the state IP laws that is administered by U.S. Patent and Trademark office and the U.S. copyright office.

The company in Iraq cannot guarantee protection of IP because it lacks law of invention made by employees (Hassan A, 2018). Even though the country has got laws regarding IP such as Iraq copyright law, the laws say nothing about employee’s inventions (Hassan A, 2018). We also need to note that Iraq is a very corrupt country having its corruption index at 18/100 at 2018 by Transparency International, with 0 being very corrupt and 100 being very clean. Therefore, your invention can be bought through corrupt deals without even you as the inventor benefitting.

Protection of PII

The U.S. based company will guarantee the protection of Personally Identifiable Information (PII). This will be done through a well written data policy that will adhere to the privacy laws of the state or federal laws.

The Iraq company cannot guarantee protection of PII because Iraq lacks data protection law and it also has no data protection authority (O’Connel N, 2019).
