The following is your legal research paper topic:

Should a workplace be allowed to subject an employee to disciplinary action (including discharge) if the employee does not return to work because that employee believes they may incur a higher risk of severe illness due to exposure to Covid-19 infection?  If so, should this apply to all employees who have that belief or should there be some underlying conditions (including age) for exempting only employees who meet certain criteria that would subject them to a higher risk of illness from Covid-19 exposure? Discuss all viable options and sides.  

(Remember this is a law course so you must bring the law (especially the current law) into your paper (this may involve statutes, administrative rules, court cases, etc.)  You should bring in original legal sources if applicable.  This is a law class, so I do not just want your opinion.  As this is a developing problem, you should also bring in any current or pending laws (states or federal, etc.) and possible challenges to these laws into your paper. 

 

Legal Research Paper

A legal topic in Health Law must be researched, written in a 6-8 page research paper (not counting a title page and Bibliography and abstract if you have one).  You must have a Bibliography in accord with APA style.  The paper should investigate all sides to the issue(s).  Deductions will be made if a paper only shows one viewpoint.  In addition, papers will be graded on form.  Writing style, spelling and grammar, is expected to be at the graduate level.  You should follow any other instructions or guidance provided by the Instructor.  

 

Papers are to be double-spaced, 12 point Times New Roman font with normal 1-inch margins, and submitted per the due date specified in Canvas assignment through Canvas, which will include instructions.  . You should follow APA citation style. Please also see the BGSU academic honesty code for further information on plagiarism and citation.  All work should be yours alone, with no help or assistance from anyone.  All projects must be sent to TurnItIn on Canvas by the due date of Sunday, July 12, 2020, 11:59 p.m.

  • See all of the instructions/guidelines documents and postings in Canvas

  • Remember to use APA citation style—do not make up your own style—it is not fair to those who make good effort and take time to correctly cite.

  • Although it is difficult to state the exact number of sources as the subjects are different, this is a legal research paper so at least 5 sources should be utilized for this size paper. This is a law course, so you should bring the law (especially the current law) into your paper. (and may involve statutes, administrative rules, court cases, etc.)  You should bring in original legal sources if applicable.  (This is a law class, so I do not just want your opinion.) 

  • The BGSU Library is a good source for research help and I also recommend the Writing Center (I believe you can work with the Center online) to review your writing. (There are librarians who know legal research, so contact them early.) 

  • Reminder, do not plagiarize as the university takes this very seriously. There is no need as you can cite various sources for the facts and various opinions and sides to the issue.

  • As instructed, you must investigate all sides to the chosen issue.   • Do not take up a space with long quotes, spacing with headings, etc. You need to write a good paper and rewrites and edits (where needed) are essential. 

 

The University Library can help and there is usually a research librarian you can contact on the phone or online.  BGSU Library has a chat (and if you are on the main page, there will often be a pop-up that will ask you if you want to chat with a librarian).  I believe the Learning Center in the Library on campus will also review your writing and citation—they will not write or re-write a paper for you—but you must contact the Center and get a draft to them well in advance.  Editing and re-writing will help refine your work so do not postpone working on your paper.  Sources cited should be reputable sources (not Wikipedia) that are respected by academic scholars.  (No Wikipedia or blogs (except respected reputable blogs, like New York Times, Washington Post)). 

How you structure the actual analysis is somewhat flexible (e.g., one possible avenue is to provide one side and relevant law and/or cases and regulation, then the other side of the issue, with the relevant law/cases/regulation).
