QUESTION 1

In no more than 1000 words, critically analyze the case of Julian Robinson v The Attorney General of Jamaica [2019] JMFC Full 04, within the context of constitutional supremacy.

QUESTION 2

a) Harry, Catherine’s ex-boyfriend who had a spear key to her apartment, sneaked inside the house one late night and proceeded to have sexual intercourse with her. Catherine slept through the entire episode, not knowing that Harry was having sexual intercourse with her. Catherine eventually woke up with a burning sensation in her vaginal area and with Harry standing by her bedside. Harry confessed to her that he could not resist the urge because she looked unusually attractive whilst asleep.


Advise Catherine on the criminal liability of Harry, if any.

b) Would your answer in (a) above be any different, if whilst having consensual sexual intercourse with Harry, Catherine tells Harry to stop, but he continues nevertheless? Provide reasons for your answer.
