Weekly Reflection/Reaction Paper

Each week, students must complete a class preparation paper, which should include (1) a short reaction to the reading, highlighting its argument, major themes and your thoughts/analysis about points raised (please note, you can also use this space to engage the reading creatively through poetry or spoken word); (2) at least three quotes from that reading; (3) at least three questions about that reading.  It is estimated that each daily class preparation will be 1-2 typed pages.

Discussion - Trial Misconduct


There is a connection between government “misconduct” and the conviction of “innocent” people. The prosecutor, aided by the police, has the power to shape proof and control its presentation toward a preconceived result. Defense attorneys are sometimes at fault. What kind of reforms can be implemented to diminish the misconduct?

I think that there is a connection between government "misconduct" and the conviction of "innocent" people in some cases. Prosecutors hold a lot of power and you really hope that they are a good person doing the right thing. I was surprised watching the video about the prosecutor apologizing to the man that he got falsely convicted. I just don't understand how someone could knowingly get a person convicted when they didn't do the crime. In one of the other videos it talks about how a prosecutor had multiple misconducts but nothing was really done about it. If they discover that misconduct is occurring or even suspect it from a prosecutor they should be put on leave and it should be investigated immediately. Accusations should be taken seriously, this is the only major way I can think of diminishing the misconduct.
