Richie Realtor has a listing agreement with Sara Seller for the sale of her home. Sara is taking Richie on a tour of the house describing the advantages of the home but also some of the problems with it. Sara tells Richie in confidence that during the rainy season in August and September her back yard is completely wet. Depending on the amount of rain, the yard can be completely under water and other times it's just damp but very muddy. The water makes the back yard unusable for at least two months of the year, but the water has never reached the house. Sara does not want Richie to tell any potential buyers about the water because she is worried it will decrease the value of her home.

Richie puts the house on the market and in January Bob and Betty Buyers want to make an offer to buy Sara's home after seeing the house for the first time. The Buyers mention to their Realtor and Richie that one of the things they really like about the house is the large fenced-in back yard that their three young children and two dogs will love to play in.

A Realtor has the fiduciary duties of loyalty, confidentiality and disclosure; so should Richie tell the Buyers that the back yard is unusable for at least two months of the year? Please explain the basis and reasoning for your answer.
