Peter Plaintiff and his pals go to this new place called Al's Ax Throwing Bar. Peter and his pals have some dinner and beers and then decide to throw some axes. Al is very careful to have every patron sign a waiver that they won't sue him if they get hurt when they are throwing axes. He also makes sure he tells everyone the safety rules and the emphasizes the most important one: don't get your ax from the target when someone else is throwing an ax at the target. Peter and his pals are enjoying their beer and ax throwing but in his excitement, Peter forgets the rule about not walking up to the target when someone else is throwing an ax at it. Sadly, Peter's pal accidently hits Peter with his ax. Peter's arm is almost completely severed but a quick thinking EMT saved the arm and doctors later stitched it back on. Fortunately, Peter has made a full recovery but he wants to sue Al and his stupid Ax Throwing Bar. You are Peter's attorney so please discuss the merits of his case. Include the elements of premises liability: duty, breach, causation and damages. Then discuss comparative fault and any other defenses Al may have that will weaken Peter's case.
