The Third Strike

Abstract

The three strikes rule is an essential rule that helps the society to be safe and the government to increase public safety. The private sector on itself utilizes the three strike rule to ensure that the person that they are hiring is not a repeat offender of various crimes as this will put their reputation in jeopardy. The person might prove to be of risk to the stakeholders of the company if they are hired and hence all the necessary steps should be undertaken.

The three strikes rule

Organizations live by a strict rule which ensures that people are product both public and private corporations. When working for the government as a civil servant, it is quite hard to be fired, and this proves to be a problem towards the performance of a firm Although certain measures have been put in place to ensure that people are productive. The three strikes rules in the government can also be used to mean the number of warnings that an employee will be given before they conduct can be reviewed and a formal warning which will reflect on their careers be noted down. In law, the three strike rule is used in ensuring that criminals who have a habit of committing a crime are sentenced to serious convictions. This gives them more time to be affected by the actions of their crime and although they might not reform to their habitual nature, they will consider what their actions will lead to in future.

The private sector has to look out for its portfolio ad also its community outreach programs. Hiring people with bad reputations is hurtful to the firm’s public image, but it can be viewed as community outreach where they are giving ex-offenders a second chance. The tree strike rules are however limited to the positions that the private sector can hire someone; a person convicted of fraud, embezzlement or any financial crime on sometimes will not be favorable to any firm at any given opportunity.

Research Question

The main question that the research wants to answer is what are the main factors that influence a repeat offender and what can be done to help such a person from repeating their mistakes or even their crimes. There has been an increase of worries that the employment market is too selective as it tries to ensure that the people who are being employed have a clean record and that they share the same principles as affirm. While any firm would want a go getter, they want such an employee who operates within the legal measures but would do anything for their client. The government on the other wants to ensure that people who are employed will not put their interest first before the public and hence they will be happy to serve people.

Hypothesis

When considering the three strike rule, it is important to note that most people who are imprisoned for the same crime on a number if times have some triggers which should be considered. When analyzing the case of a violent offender, it important to look at their upbringing and how the society and the community around might have affected this. Although considered to be of little significance, the level of education that a person has achieved is of importance as it helps in identify whether someone has learned the right way of socializing and also temper management. The problem may be psychological or maybe triggered by the need to defend one’s self if living in a dangerous neighborhood. In such circumstances, it is hard to the differentiation between the victim and the perpetrator and analyzing the case for more time to take note of various factors is needed.

Private firms will also look for someone who is consistent with their results and look to go the extra mile through the right channels. This means someone who is aggressive and someone how can take advantage of various opportunities. Such a person should, however, respect the boundaries of others and their performance as this might lead to a hostile working environment especially where one employee has been noted by others to be infringing on their rights or poaching their clients.

Measurement and analysis approach

The data that will be acquired from the research will be from various points of and sectors involving the public sector and the private sector and will analyze how they are affected by various inputs on how habits affect the various stakeholders who are involved. When analyzing the tree strike rule, it is important to note that the data and the topic will not all be applicable in a legal stand point but will involve various factors. The three strike rules when applied to other factors search how employees relate to each other and the ethical standards that they are expected to uphold leads to the formation of a culture which observes the rules to avoid the ramification of absconding laws and rules that have been laid out.

Applicable resources

The resources that are going to be used are going to be derived from the internet as this will be data which is available to the public. Public courts records are available, and even the labor lawsuits are available, and they will offer the necessary data to ensure that the data progresses.

Various organizations culture will also be of use in the research, and they will contribute immensely. Organizational culture will determine what organizations prefer when hiring people and how they are supposed to conduct themselves.

Ethical standards

The data that is going to be used in this research will be factual and original not having been used in previous research programs. It will guide the researcher and those who will be analyzing and depending on the research on the application of legal precedences in other fields in the industrial sector.
