Assignment 2: Legal Issues and Discovery Requests

Part I

You are the IT manager for a small medical device manufacturing company. A competitor has sued your company for copyright infringement, and its legal team has made a discovery request under the Federal Rules for Civil Procedure (FRCP) e-discovery process. The request is for any and all e-mails related to specific keywords that they have supplied. Your chief executive officer (CEO) has asked you to determine whether the company needs to comply with the request.

Tasks:

Research the FRCP and e-discovery rules as they pertain to e-mail. Write a synopsis covering the following topics:

  • Describe the rules governing the situation.
  • Discuss specifically how the rules do or do not apply in this situation.
  • Make a recommendation to management about how the company should respond to the discovery request.

Part II

Conduct an internet search of government and career sites (e.g. bls.gov, jobs.com, monster.com, etc) to locate recent information on the career prospects for IT Managers in your geographic location. Present your findings, including related job titles, potential employers, a summary of this job function, the education and experience required to qualify for this position, and the average salary one could expect to earn.
