Address the following points in the testimony:

  • Dr. Johnson needs to be conversant in the literature detailing the reactions of victims to sexual assault, including psychological and behavioral reactions.
  • Dr. Johnson also needs to be prepared to present evidence on how many women did not report sexual assault and the various reasons they fail to contact the police.
  • She also needs to discuss with the prosecutor the pros and cons of asking these women to appear on the witness stand and testify.
  • All of her testimony must be supported by the empirical literature.

Dr. Johnson needs to explain that every assault, every victim, and every reaction is going to be different each time. There may be some components of the assault or reaction of the assault that might resemble one another, but no two assaults or reactions are going to be the same. Victims might avoid anything that reminds them of the attack. Victims might have flashbacks of when the assault took place. Disorders could also occur after an attack, such as post-traumatic stress disorder from the fear and hysteria of the attack. Rape victims may also experience depression, substance abuse, and suicidal thoughts or behavior. Only 230 out of every 1,000 sexual assaults are reported to police. That means about 3 out of 4 go unreported. Victims choose not to report sexual assaults to police for various reasons. Reasons include some fear retaliation, some believe the police won’t do anything to help, some believe it was a personal matter or it is not important enough to report. Some do not want to get the perpetrator in trouble, or some just simply do not want to engage with the matter any further and they just want to pretend that the assault never took place.  

Pros for the victims testifying would include an eye-witness testimony from the victim. An actual account of the actions that took place. Cons include that the victim has to face the perpetrator in court and recall horrifying and personal details of the rape which forces the victims to relive the crime mentally and emotionally. Defenders could trip the victim up and force them to change their story (or make it seem like the victim is lying) because they are under distress from the defender’s cross examination.
