This written report requires you to demonstrate an understanding of current legislation, codes of practice, organisation policies, procedures, protocols and industry operating conditions to enhance workplace responsiveness to legal and ethical requirements

This assessment will be assessed against the following elements, performance evidence, performance criteria and knowledge evidence;

CHCLEG001 Elements and performance criteria:

PART A

Short answer questions

To answer questions accurately, you may refer to applicable legislation including; the National Quality Standards and Education and Care Services National Regulations, Belonging, Being and Becoming – The Early Years Learning Framework, the Early Childhood Australia Code of Ethics, policies and procedures common to early childhood education and care services, position descriptions detailing an educator’s duty of care responsibilities, and/or other sources such as professional readings along with the course textbook and identified key resources.

In your own words, define ‘duty of care’ and explain ways you could exercise your duty of care in an education and care setting, in particular:

Setting up the indoor environment

Supervising outdoor play  

Explain why it is important for educators to understand the policies and procedures of their workplace in terms of their legal requirements.

Explain how you think the Code of Ethics could help you in your work role.

Describe the principles of ethical decision making.

What is the difference between values and attitudes? How would you ensure non judgemental practice in an early childhood and education setting?

What strategies would you use to manage a child protection issue such as suspected abuse of a child?

When dealing with a possible child abuse situation, why is confidentiality important for the child and the child’s family?

Describe 3 ways that you can uphold the rights of a child in an early childhood education and care service, keeping within the universal declaration of human rights in particular the ‘United Nations Convention on the Rights of the Child’.

Case study 1

A co-worker in your classroom has been arriving to work quite late and leaving early. This has been occurring since the owner of the education service went on holiday leave. It is impacting your work role and breaching child:staff ratios, as well as leading to frustration on your part. What would you do and why?

Case study 2

You are working in an early childhood education and care service when a woman comes to the service, approaches and says ‘I am Stefania’s aunty and her mum has asked me to pick her up today’. You refer to information provided at enrolment and only one person, her mother, is authorised to pick her up. What would you do and why?

Case study 3

A father makes a complaint to you that his 4 ½ year old, Jakub, is not learning enough at the service. He states that ‘he is frustrated that the educators let him play all day when they should be ensuring he is ready for school’. What would you do and why?

Case study 4

A father tells you that his newly enrolled 2-year-old daughter, Alyssa, is a ‘biter’ and gives you permission to smack her if she bites another child. What would you do and why?
