The first witness is a male secretary at the company in question. He says that he overheard his boss, a woman, speaking about this fraud out loud to herself in her office. She denies it. Do you believe him?

The next witness is a janitor who says that he overheard two business employees discussing this fraud at night in the restroom. They both deny it. Do you believe him?

The next witness is a barista at a local coffee shop who says he overheard a manager on the phone when they first discovered the fraud. The manager denies it. Do you believe the barista?

Now in this example, you are still on a jury for a fraud case. But it is a small Mom and Pop store from your local town.

The first witness, a woman, who was hired as a cashier a few months ago said that she overheard the owner, Fred, talking about this out loud in his office one night. Fred denies it. Do you believe her?

The next witness is a neighbor who happens to work with a competitor of this company. He says that he overheard the son, Fred Jr., talking about this fraud while smoking outside with a friend. Fred Jr. denies it. Do you believe the neighbor?

And the final witness is Fred’s niece who says that she saw paperwork on her uncle’s desk that covered of the fraud. The paperwork is gone and Fred denies it. Do you believe her?
