1. Before answering the questions below,we should evaluatehow United States v. Nixon got to the Supreme Court. An investigation ofthe 1972 break in atthe Democratic National Committee Headquarters at the Watergate Hotel revealed that the burglars had connections to the campaign to re-elect President Nixon. The congressional hearings on the break in scandal revealed that a tape recording device had been installed in the oval office by President Nixon. Obviously, the prosecutor in charge of the case wanted to obtain tapes of the discussions in the oval office in an effort to prove that President Nixon and his staff had abused their power and violated the law. Nixon eventually released edited transcripts and condensed versions of the tapes. His failure to fully comply withall of theprosecutor's demands were challenged in court which ordered Nixon to fully respond to the prosecutor's requests. Nixon appealed the lower court's decision to the US Circuit Court of Appeals. The prosecutor requested the US Supreme Court to hear the case. Nixon'sattorneys argued (a) that the case couldn't be heard in the courts because it involved a dispute within the executive branch and (b) that the president's executive immunity and privilege, although not specificallydetailed in the US Constitution,protected the tapes. The prosecutor claimed that to give the President of the US absolute executive privilege would provide an unchecked power and undermine the law.
