Under the doctrine of respondeat superior, an employer is deemed liable for acts of employees in certain situations and for certain damages. In this case, you are to look at what those situations are and if they apply here. In addition, what are the damages that can be claimed? How would they be claimed and whom would they be claimed against? Dr. Jacobson was 48 years old and making a substantial income that his family was likely counting on. How would you calculate the damages?

Vern Jacobson, a prominent cardiologist residing in Scranton, Pennsylvania (Middle District), was killed in an automobile accident by an employee of Zenith Corporation, a West Virginia corporation, while driving in Scranton. The state police report indicates that the employee was at fault. Under the doctrine of respondeat superior, Zenith Corporation is responsible for the acts of its employees. Dr. Jacobson was 48 years old when he died and he earned $422,250 last year.

The executor of the estate of Vern Jacobson has hired your law firm to sue Zenith Corporation. Your supervising attorney asks you to link the complaint and summons to the matter in AbacusLaw, CLIO, or another law-office-management software.
