 In the United States, there is a clause in the law that provides for an understanding that there are circumstances where people will react violently in the heat of the moment. It is a killing that would otherwise be murder that is reduced to voluntary manslaughter if the defendant killed someone in the heat of passion (Dressler, 1982). When Jim Aiken came upon his wife cheating with the mailman, he immediately killed the mailman which makes for a voluntary manslaughter charge. Jim Aiken is an average man who is driven to crime by overwhelming external events. If that was where the violence ended, then at worst Jim would be facing a few years in prison. However, after killing the mailman, Jim went downstairs and ate, leaving his wife upstairs with the dead man. A couple of hours later after Jim finished his meal, he returned upstairs and killed his wife. At that point, it is no longer in the heat of the moment. When Jim Aiken killed his wife, it was first-degree murder or capital murder because he took the time to calm down, eat and think about his next step. First-degree murder or capital murder involves components like deliberate planning, premeditation, or malice (staff & staff, 2018).
