In my opinion, I believe that Frederick should proceed through some form of alternative dispute resolution (ADR) rather than filing a lawsuit against his professors. When filing a lawsuit against friends or colleagues, feelings can easily be hurt and relationships can just as easily be broken. Seeing as Frederick shares his idea with “trusted professors,” as the case study describes them, I can assume that they have a friendly relationship. Our textbook gives a few methods of ADR, including the three most common formal methods of arbitration, mediation, and expert evaluation (Melvin, 2021). In my opinion, any of these three would be better options than suing the professors.

Specifically, I believe that mediation is the best form of alternative dispute resolution in this case. Mediation is when an impartial mediator listens to the parties while they tell their sides of the story, and then he or she helps identify issues and offers solutions for both parties involved (Newman, 2020). While there is someone else involved in the process, mediation still leaves the outcome up to the two parties in the end. This method of ADR is the best one to use when the parties have a relationship that they want to preserve, because a mediator can help people communicate calmly and effectively (Newman, 2020). I chose mediation specifically for that reason.

Additionally, if Frederick is a Christian and lives his life as the Bible tells him to, he will definitely agree with my recommendation. In the well-known verse, Matthew 5:39, Jesus says, “But I say to you, do not resist the one who is evil. But if anyone slaps you on the right cheek, turn to him the other also” (English Standard Version Bible, 2001). Jesus tells us not to retaliate when someone, friend or not, hurts us. Rather than suing “those professors for everything they’ve got,” Frederick can choose not to retaliate harmfully, and instead he can resolve the issue peacefully. In this case, if Frederick wishes to obey Jesus, he will most likely heed my advice and move forward with mediation of another form of ADR.
