The ADA and IDEA Point of View of Rights Granted to Individuals with Disabilities

This subject of students with disabilities is something that I am personally familiar with, in that I was one of those students. I was just looking at my IEPs and seeing what was all entailed in it, as well as the doctors notes that were given to my parents. This helps me to sympathize with L.K. and her parents with her struggles with her disabilities. I am glad to see that the parents were awarded the years pay back, but I do not believe that was enough. It is not right that the students teased her, that the teachers did not do anything about and that those in the IEP meeting shrugged the subject off when the subject was brought up about L.K. being bullied. I personally believe that all those individuals should have been dealt with according to their understanding of the matter. It was concluded that the parents made the appropriate decision of moving their child to a private school that would “reasonably calculated to enable the child to receive educational benefits (JUSTIA, 2016).”

There are a few ways in which Americans with Disabilities Act of 1990 (ADA) and Individuals with Disabilities Education Act of 1975 (IDEA) helped to enhance students with disabilities in schools in many ways. The first right is that students with disabilities may not be discriminated against, and if so, the incident has 180 days to be reported to the Justice Department. From there the department will investigate the incident and decide the best settlement for both sides (McCarthy et al., 2014, p. 170). A good fact to know is that all states participate in IDEA funding programs which help to provide aid were needed for students with disabilities. The student has to meet specified conditions to receive IDEA services, which will then turn into an Individualized Education Program (IEP). This is where the parents/guardians, a special education member, the child if appropriate, along with other specified educators prepare an IEP which helps provide the student with appropriate individualized assistance in order to be successful in school.
