“Policy” is basically a business’s governing policies, regulations, principles and guidelines for adherence by employees within their business organization. Policies are implemented to set the standards of conduct, principles and regulations to manage personnel and prevent or eliminate problems; to focus on the businesses long term directives and objectives. The example of a “Policy” is when a business has an established documented written policy that states if an employee is caught illegally stealing any property or services from the business; they will be terminated immediately for unacceptable elicit behavior.
“Law” is defined as the binding rules of conduct meant to enforce justice or obligation and derived largely from custom or formal enactment by legislature. These specific laws carry with them the power and authority of the enactor, and associated penalties for failure to obey laws (Web Finance, 2017). The example of a “Law” is when an individual is working at a large corporation; and decides to steal $1400 Flat Screen Television from the store. They could be legally prosecuted; because it is a crime to steal and is against the law. The law for theft of any property valuing one thousand to two thousand dollars is a Class 6 Felony and could carry a maximum prison sentence of two years (Stewart Criminal Law, 2017).
Business policies do not override a local, state or federal laws, by which local, state or federal laws can override business organizations policies. Businesses need to establish policies that will adhere to the governing laws that are local, state and federal laws related. If they violate the governing laws for non-adherence it can result with legal repercussions such as; high penalty monetary fines, potential prison sentences, felony charges and even having their business closed. There is an exception to the rule though; there are no federal or state laws that mandate that benefits such as holiday and vacation pay.
A perfect example of a business that illegally broke a federal governing law was Walmart; they pleaded guilty to six counts for non-adherence violations to the Clean Water Act. This illegal behavior was caused by the improper handling and disposing of hazardous materials from returns from customers within several of retail stores. They also violated Federal Insecticide, Fungicide and Rodenticide Act by failing to properly handle pesticides, being returned by customers. They pled guilty for the criminal charges against them and paid fines of $110 Million dollars for their unlawful illegal behavior for violations governing the federal and state environmental laws (U.S. Department of Justice, 2013).
Walmart did not have a policy for the proper handling and disposal of hazardous materials; nor was their training programs established to teach employees how to dispose of chemical related products that are returned to the stores. But; after this illegal behavior Walmart, has implemented procedures for safe handling of hazardous wastes at all their facilities nationwide. They are committed to preventing future occurrences within their business operations.
