Mary worked as a general operative for 'ABC Cosmetics', the company outlined above. One of the products manufactured was a bath oil which was dispensed into 250ml plastic bottles. On the morning of Monday 24th May she was working on the filling line which dispensed this product. There was a problem with the filling machine - it dispensed 500ml which was the quantity required for the previous batch of product. This led to overfill in the bottles and subsequent spill to the floor which spread out to a few feet from the machine area.

Mary tried to fix the machine having watched maintenance staff perform this before as her employers had informed them that the order needed to be finished by the end of the week. John who worked in the warehouse and collected the filled product walked into the filling area and slipped on the spilled product damaging his wrist. He was off work until the 31st May due to his injuries. The floor in the filling area was tiled and the bath oil was a clear product. The operatives in the production area were issued with a uniform when commencing work.

Ann who also worked in this area mentioned that she had been working on the line 3 weeks previously when the same problem occurred leading to a near slip. She reported this at the time to her area supervisor who said she would inform the maintenance department when she got a chance. The company was very busy at the time trying to complete an order for an important customer. There were three other operatives working in the area at this time.
