There have been a number of legal cases in which judges have argued that social context should be a contributing element in the process of judicial decision-making. Based on R. v. Ipeelee, discuss to what extent judges should take social context into consideration when making legal judgements. You must argue your position either from a classical legal approach (this would include considerations of rule of law) or from a critical approach by using the theoretical ideas of CLS (critical legal studies), critical race and/or feminist legal theory.
