This week we learned about writing clear memorandums and demand letters. Most demand letters include (1) a statement of facts establishing that the client has a legitimate legal claim, (2) a discussion of the law showing the legal basis for a cause of action, (3) an itemization of damages that were incurred, and (4) a demand for a specific settlement. Sally and Billy Preston are the parents of Johnny Preston. Johnny Preston has been in lots of trouble growing up, and has recently been placed into jail for numerous burglary and robbery convictions. Some of Johnny’s victims have been harassing Johnny’s parents wanting to know where their stuff is. Sally and Billy have had to call the police on numerous occasions because people are trespassing on their property and harassing them. However the police really have no basis to arrest anyone. Sally and Billy Preston have contacted an attorney and have asked that a demand letter be sent to everyone that they feel has been harassing them.
