This is particularly relevant to Asia, an area that has expanded economically both regionally and internationally. The increase in cross-border trade corresponds with an increase in commercial disputes and an increase in divergent legal systems.

For international and regional actors facing dispute resolution in Asia, it is therefore important to select arbitration as an alternative to formal litigation. This is particularly important because conflicting laws will usually arise in cases where parties from different jurisdictions encounter disputes. Even if the parties select a specific legal system to govern the contract there are bound to be other issues such as costs, enforcement, and delays associated with international litigation.
