Currently, I am studying duty of care in Torts and I am having trouble grasping my head around the current approach of the HCA. What I think is that in order to prove a duty of care exists is that the Plaintiff will be required to prove the harm they experienced as a result of the defendant was reasonably foreseeable AND they should also prove some salient factors in accordance with Sullivan v Moody. Can you please advise if there are any gaps in my knowledge.
