An abstract is required. “Several years of experience in addressing the HIV/AIDS epidemic have confirmed that the promotion and protection of human rights constitute an essential component in preventing transmission of HIV and reducing the impact of HIV/AIDS”3 “It is trite to say that law cannot be a panacea for all social ills… the use of criminal law will not be counter-productive, and it will not do more harm than good.4” Hence, special attention should be given to the principle of non-discrimination and equality, and the principle of due process, of international human rights norms, when crafting legislation or policy related to HIV/AIDS, in the light of past and ongoing discrimination and stigma against people living with HIV/AIDS and we should refrain from the coercive use of state power, through invoking criminal law, in the overall pursuit of public health.

The terminal stages of HIV have termed AIDS which weakens the immune system so fatally. even a common cold could have disastrous effects on its victims. Around 39 million people have been infected with this virtually fatal condition, by the end of 2004, and claimed more than 3 million lives, especially in the poor and underprivileged areas of the world. Sub-Saharan Africa is the frontrunner in a contraction of HIV/AIDS in the world, where over 25 million are affected by it. Subhuman living conditions and lifestyle are contributing to growth in no small measures. 5

The existing laws on appropriating blame, on alleged offenders in cases of spreading and transmitting HIV/AIDS, needs to be made more effective and culpable, especially because the determination of the time when a complainant is actually infected remains in the realms of real doubt.&nbsp.
