In the given case, the concession worker did not intend to give Daniel sugary soft drinks, and he did not intend to cause him harm by doing so. He did not know that Daniel has diabetes. The potential defendant is the concession worker while the potential plaintiff is Daniel. Daniel is the victim of the negligence of the concession worker.
The possible defense the concessioner worker can claim is that the condition that happened to Daniel is not caused by his negligence. The worker can claim that the sugary soft drink is not the proximate cause of Daniel’s diabetic coma. He can present other possible causes of the coma to prove that he is not guilty of the felony.
