(French, 2007 p. 114) “Chief Justice Warren Burger delivered the Court's opinion that employers can use intelligence tests only if "they are demonstrably a reasonable measure of job performance" (“Griggs v. duke," 2011). What Duke was doing was basically segregating employees based on race. African Americans were only able to work at the low paying labor jobs. When the Civil Rights Act was passed, they then began to require a HS diploma or a certain score on an intelligence test for employees to be able to have other higher paying jobs. This also eliminated many African Americans from the higher paying jobs because they scored lower than the whites. The Supreme Court found that this was discrimination if the company was not able to prove that the testing was directly related to the job itself. The impact that this ruling has had in HR is that employers cannot discriminate against different races and eliminate them with testing that is not related to the job they are applying for. The HR department has to ensure that any and all testing is legit and not discriminatory. Arizona v. Norris (1983) was a significant case for women. Women were being paid a smaller amount of retirement due to the difference in life spans of men and women.
