When we look at Federal vs. State control of education McCarthy, Cambron-McCabe & Thomas (2009) states “A constitution is a body of precepts providing the system of fundamental laws of a nation, state, or society. The United States Constitution establishes a separation of powers among the executive judicial, and legislative branches of government.” Therefore, because the U.S Supreme happens to supreme law when it comes to education within the nation, the states authority must be carried out with consistency with the provisions. Looking at it on a federal level their hands are tied to what they can and can’t do and it’s basically in the congress control especially with the use of federal aid.

So, as you see here it seems that federal pretty much handles the funding aspects and the state carries out any decisions pertaining to education. When we talk about how the local school board plays an intricate part in this they hold the powers specified or implied in state law and other powers considered necessary to achieve the purposes of the express powers” (McCarthy, McCabe-Cambron & Thomas, 2009). For an example, when COVID-19 hit and the impact it had on education, Governor Desantis collaborated with the input from the Superintendents from the School District to see what is best for our students as far as a re-opening. He didn’t just overrule and make the decision without first consulting with the schools in this state.

I believe that it is very important to understand school law especially in my role because you know what you can and can’t do and what decisions require the input of someone of a higher authority. It’s extremely important to know who holds the power and who controls what.
