FIRST ASSIGNMENT(1)

Our client, Naveen Anumula, along with his wife and two children recently visited a local restaurant, The Feeding Trough. During the visit, our client and his family was served a meal that included some fried fish. The entire family began eating the fish soon after it was served. After eating some of the fish, our client noticed that the food had maggots in it. Upon seeing the maggots, our client’s wife, Meghana Anumala, immediately vomited. She later told us in confidence that she is certain it was only because she was disgusted. The restaurant management offered to refund our client’s money, but refused to offer any other compensation. Unfortunately, the manager disposed of the food before it could be tested.

Our client took his family to the hospital to be checked, and there appeared to be no other signs of food poisoning at that time. The total cost for the hospital visit was $1,240.00, which was paid in full by our client’s health insurance company. The next morning one of our client’s children had severe stomach cramping, diarrhea, and vomiting that lasted for approximately two days. Our client did not return to the hospital, but he is certain the health condition was caused by this incident. Our client wants to be compensated for this experience.

Please research what compensation is justified in this situation using at least one Library resource. Is it limited to actual injury, or is compensation also available for mere disgust? Are all members of the family entitled to some compensation, or is compensation only available to some? Have any similar cases ever been litigated, and, if so, how have courts handled similar cases? Once these issues have been thoroughly researched, please set a reasonable amount of compensation, and then draft a demand letter that includes authoritative legal justification for the demand. In this Assignment you are asked to draft an Objective Memorandum based on the following scenario.

Scenario:

    1. Ms. Nishitha Rao passed away on this day sixteen months ago.
    2. Her brother, Nikhil Rao, was appointed to be executor of her estate and trustee of her revocable living trust.
    3. Her home, vehicle, and all of her bank accounts were held in the name of her trust, The Nishitha Rao Revocable Living Trust. She had approximately $5,000 worth of various household items that were not in the trust.
    4. Mr. Rao distributed the assets held in the revocable living trust to himself and his brother (Ms. Rao’s only living relatives) according the distribution terms of the trust just 5 days after Ms. Rao’s death. The household items were sold at an auction approximately one month after Ms. Rao’s death, and the proceeds were immediately split equally between the Rao brothers according to the terms of a valid pourover will.
    5. Sometime before her death, Ms. Rao borrowed $20,000 from our client. She had been making regular monthly payments on the amount owed, but payments stopped after she passed.
    6. Our client did not know that she had passed, but explained that he “was in no hurry to hassle a little old lady about money.” He just now learned of her death and would like to collect the outstanding amount from the estate.
    7. Mr. Rao has refused to give us a copy of The Nishitha Rao Revocable Living Trust.

Instructions:

  • Draft an Objective Memorandum based on the scenario described above.
