Daniel Kaffee takes a quick assessment of the evidence while he is batting a baseball and determines what he will present as a plea agreement. Moore, as Lt. Cdr. JoAnne Galloway, points out that he had not talked to any witnesses nor reviewed any of the information but had already made a decision on what his clients deserved in terms of a ‘deal’. The problem with the deal is that it did not reflect the truth in relation to the truth. At this point in the film, Kaffee can be seen as a callous leader. He is heading up a defense and does not care about the guilt or innocence of his clients. It is the influence of Galloway’s highly ethical consideration of the case that eventually changes his mind (Nicolaides & Reiner, 1992).

At this point, the toxic qualities that Kaffee shows, as defined by Johnson (2012), include a lack of integrity as he leads his followers into worse situations than they are currently in and he shows an incredible amount of arrogance and ego in the process. If his plea bargain were to go thru the defendants would go from a place where they are innocent and fighting for their own sense of integrity to a place where they admit guilt where it is not true. The plea bargain would mean that everyone in the room would be the party of promoting a lie. Galloway, however, will not have the truth ignored and it is through her challenging Kaffee that he begins to rise to the occasion.

The second major ethical problem that must be addressed is the truth of guilt or innocence. A court of law, as it is reflected in the movie industry, is a theater in which either one story or another is more plausible. In the film, the lie has been constructed that two men, Pfc. Louden Downey and Lance Cpl Harold W. Dawson took it upon themselves to do a ‘code red’ on Pfc. William Santiago because his performance had been sub-standard.
