Same-sex marriage is known as gay marriage or homosexual marriage that is, it’s a legal union between two persons of same sex, its relationship between two men or two women. There has been a lot of arguments about legalization, and this has led to a frequent visit to courts. Some people favor same-sex marriage and have been supporting it. Although the number of those people opposing this type of marriage is higher than those supporting (Lee, 2010).
According to Mello (2010), supporters of same-sex marriage have been placing their arguments based on a legalistic view. They place this type of marriage as a benefit to them, a legal right and others see it as an obligation that has to be considered like any other type of marriage. The issue of same-sex marriage has been placed in a position that requires the law to view this marriage as equality for women and men. Although the law has been to this, it has not stated its argument or its view on the issue.
According to opponents of same-sex marriage, the legal opinion does not consider the fundamental essentials of marriage, including the social view. Marriage is a traditional thing that originated from early life. By allowing same-sex marriage, it is a way of destroying the meaning of marriage in the society, especially to the future generation. Marriage as a responsibility possess some common understanding and comes with expectations that have existed for many years. As much as the supporters need the law to enforce their idea, the same law will be required to intervene and ensure the traditional understanding of marriage is not undermined. Making changes to marriage issues will destroy the tradition (Wedgwood, 1999).
Although the argument by supporters has been convincing and compelling, various aspects of marriage deny them the right. By focusing on both legal and marriage social dimension, marriages of the same sex does not reflect a mutual reality in the society. By viewing this marriage on legal dimension, the law seems not to support the banning of same-sex marriage.
According to Sterngass (2012), in the society marriage has a social meaning that includes, prospects and a common understanding that is shared by all members of the society. Marriage is a strong institution that is well understood by every individual. The young members of the society have a clear understanding of what marriage entails. When instances of same-sex marriage are heard of by such young members, to them it looks like evil.
Various assumptions about marriage have been stated saying, that marriage comprises of sexual relationship that leads to child birth. The second assumption states that marriage involves cooperation in both economic and home necessities, even taking care of children. Marriage is described as a long-term vow, and lastly that marriage is the union of a man and a woman. Same sex marriage does not meet some of those assumptions including, ability to give birth.
Marriage as an institution needs to show its benefits and its support to the social background in the society. The assumptions are created by the society members especially when they observe the signals made by the marriage partners. The community members interpret the relationship based on those assumptions because marriage is a very delicate institution and every individual in the society can apprehend the signals. Same-sex marriage tends to indicate a signal of lost hope and a bad picture to the future generation (Sterngass, 2012).
A theoretical view stated that most of the same-sex couples always want to create a marriage institution that incorporates social meaning like that of heterosexual marriage. This seems difficult because the social meaning has a tangible meaning in the society. Same sex relationships cannot afford the magnitude of benefit created by opposite-sex marriage. This is because to the society same-sex marriage is given a very different interpretation.
If the law goes ahead to allow same-sex marriages, this will change the social meaning of marriage. It is believed that a relationship between a man and a woman creates a stable social meaning to the society. The supporters of same-sex marriage, however, have not stated whether they will implement new elements of social meaning that will compel with their views (Mello, 2004).
The law views marriage as a partnership of equals. If same-sex marriage will be allowed, then change to social meaning is necessary to maintain justice. By changing the social meaning of marriage, the same-sex marriages will be included to participate in the society, and its mandate and expectations will now be expressed to the general public without fear of victimization (Sterngass, 2012).
Many governments have allowed same-sex marriage, but some have not because they believe this will affect their religious beliefs. Same-sex marriages statistics shows that this issue has impacted a large group of people on the daily analysis. The ages between eighteen to twenty-nine years old have been rated as the highest supporters of same-sex marriage while sixty-five years and above show lower percentage. The eastern part of United States has the highest number of supporters and Midwest the lowest. The first country to allow same-sex marriage was the Netherlands in 2001 before the US legalized theirs.
Although same-sex marriage is stated to lack social meaning, its very important to support the ideas from state members to help develop a peaceful country. Same-sex marriage supporters need to be allowed to try their view and later determine which side to fall in, either same-sex marriage or opposite sex marriage.
